1. Purpose

This policy is established to ensure that the use of brand samples by Creators is strictly controlled, minimizing financial loss risks and ensuring that Creators fully fulfill their assigned tasks on the Permate platform.

2. Eligibility Criteria for Receiving Samples

2.1 Definition of “Creator”

A Creator is an individual or organization that owns or manages digital content channels (e.g., TikTok, Facebook, YouTube, Instagram, or other platforms) and participates in promoting products/services for brands via the Permate platform.

Creators may include:

• KOC (Key Opinion Consumer)
• KOL (Key Opinion Leader)
• KOS (Key Opinion Sales)
• Content Creator / Influencer
• Partners or MCNs (Multi-Channel Networks) managing Creators

2.2 Conditions for Receiving Samples

Creators are only eligible to receive samples upon meeting the following requirements:

• Successful completion of KYC (Know Your Customer) on the Permate platform (including Citizen ID/Passport, valid payment information, and contact details).
• The account must not be in violation of Permate’s Community Guidelines.

Permate reserves the right to refuse or revoke sample eligibility for accounts flagged with high-risk indicators.

3. Task Commitment

Upon receiving samples from a Brand, the Creator is required to:

• Complete the assigned task (Video/Post/Review) as specified in the offer on the Permate platform.
• Deadline: Tasks must be completed within a maximum of 30 days from the date of sample receipt.

Permate and the Brand reserve the right to issue reminders to the Creator during the task execution process.

4. Non-performance of Tasks

In the event that a Creator fails to complete the task within the designated timeframe:

4.1 Case of Task Rejection

The Creator must:

• Notify the Brand and Permate of the rejection via email within 2 days of receiving the sample.
• Return the product to the Brand at their own expense (shipping costs).
• Timeline: Return must be completed within 5–7 days following the notification.

4.2 Case of Non-responsiveness / Failure to Return Product

Permate shall implement the following measures:

• Issue an official account warning.
• Suspend the right to participate in offers on the platform.
• Lock or restrict the Creator’s account.

Additionally, the Creator will be required to compensate double the value of the product in accordance with the agreed terms.

4.3 Brand Reimbursement Policy

In instances where the Creator fails to complete the task and does not return the sample:

• Permate will support the Brand with a reimbursement of 50% of the product value.
• Maximum Reimbursement: 3,000,000 VND per product.

5. Responsibilities of the Parties

5.1 The Brand

• Provide clear and detailed task requirements within the offer.
• Support the Creator in fulfilling the task.

5.2 The Creator

• Fully comply with all requirements and policies of the accepted offer.
• Preserve and use the sample for its intended purpose.
• Return the sample on time and in its original condition if the task cannot be performed.

5.3 Permate

• Monitor KYC verification and Creator performance history.
• Provide support in issuing reminders, handling violations, and protecting the interests of all parties.

6. Validity

These terms are applicable to:

• All offers involving sample product distribution are conducted on the Permate platform
